I wonder if this promo CD was ever intended for public release? If not, then how did a batch of them find its way into Ebay or even China?

I'm not sure that it was Tin, but promotional recordings find their way onto Ebay all the time.

I must have 20 or more various Hayley promo's in my collection, mostly from that source.

I have this song now, thanks to Paulo. He's been generously giving me some songs that I'd been missing, such as Dido's Lament, On My Heart, My Heart and I, as well as Time to Say Goodbye. I'd heard some of these on Youtube before, but I wanted them for myself so I can burn them to a CD.

Anyway, I was wondering if anyone knows, if Hayley specifically recorded the song for that Japan compilation because they asked her to, or was that an extra song that they decided not to put on Treasure? It doesn't seem fair that Japan got that new song. I see no reason why it couldn't have been put on her own album. That's a popular song, and she sang it so beautifully!

Is not my wish to promote piracy, and I don't want to prejudice Hayley, or her record company in any way.

I have all the official albums (some different versions, Purchased here in Portugal as an Import, from CdJapan, Amazon.uk, HMV Japan, HMV Hong Kong and lately ebay from around the World), I have also Itunes gift cards to buy songs from the UK and Japanese stores (I don't know if this is illegal too, but is the only way for me to get for example the Itunes EP, which I don't know if one day will be available here).

When I read Libby's post in the official Forum, that despite her having Hayley's albums, she missed some of the songs due to all different versions.

I bought these songs in ITunes and offered them to her.

Hi Paulo,

Most of what you say is fine and perfectly legal but I'm not so sure about the last part. If you paid iTunes but then allowed someone else to download them (assuming such things are possible) then that is perfectly legal. But, if you downloaded them for yourself and also passed the files to someone else, then two people have ended up with copies even though you only paid for only one. That would be illegal.

Well, not so in Spain. If you pass a copy of a CD to someone else without making money from it, it is perfectly legal. "Private copy" it is called. Maybe in Portugal it is similar.

We shouldn't really get into a detailed copyright debate here but a few words of explanation will I hope be helpful.

Because copyright law varies between different Countries we have had to introduce a policy based on the situation in most Western democracies. Yes, Spain and a small handful of other "Western" Countries do seem to allow this kind of copying, with conditions such as a blank media tax as compensation for the income loss of the record companies and artists. But as I understand it, the European Union forbids any Countries that do not already allow it from allowing it in future. So in Spain, private copiers are some of the 'fortunate' few.

Our guidelines were written to cover the situation in most of the "Western World" and particularly, what we believe Hayley's UK based record company and management will accept. We have to be aware also of US Law, because Proboards is based there. So as Roger has already said, we ask all members in all Countries to be aware of our copyright guidelines and in particular, to take care about what they say when posting messages in the forum about commercially available recordings. I didn't know any of that was illegal, and I certainly didn't mean to get Paulo in trouble. Again, I apologize, Paulo. I didn't think someone would do that for me if it wasn't legal.
I mentioned once that I didn't have these songs, and couldn't find them available for download anywhere, and Paulo offered them to me.

Anyway, does anyone know the answer to my question, or not? Did Hayley record Time to Say Goodbye specifically for that Japanese best of CD, or did she originally intend to record it for Treasure, but they just decided not to use it? I would think that people in the UK and the U.S. would like to hear that song, too, so I don't think that's fair. It seems to be a popular song.
