HWI COMPETITIONS AND PRIZE DRAWS
General Rules, Terms and Conditions
These General Rules, Terms and Conditions are applicable to all competitions and prize draws run by Hayley Westenra International - hereinafter referred to as HWI.
1. Entries must be submitted in electronic format as detailed at the time of each competition.
2. Entries must be received by 23:59 GMT (or any other time specified in the rules for a specific competition) on the closing date as set out in the rules of the specific competition. Proof of submission will not be accepted as proof of receipt.
3. There is a maximum of one entry per HWI member, unless otherwise stated in the rules for the specific competition or contest. Entries in excess of this limit (including those from any multiple forum accounts of the same person) are liable to result in disqualification of all entries from the member or entrant concerned. HWI staff or appointed competition organiser alone will determine what are multiple entries.
4a. One or more HWI members of staff will collate all entries and determine the winner(s). Alternatively, at the discretion of the HWI members of staff, the winner(s) may be decided by a poll of forum members to be set up by a member of the forum staff, and the actual method to be used will be stated in the rules for each specific competition.
4b.In the event of more correct entries than available prizes (if there is a material prize), winners will be drawn at random from among all the correct entries, or by the use of a tie-breaker question. The decision of HWI and/or the competition organiser(s) will be final.
5. Winner(s) of any material prize(s) will be notified as soon as possible after the competition has closed. Return of any prize or prize notification as undeliverable will result in automatic disqualification and an alternative winner may be selected, at HWI’s discretion. If a winner declines his or her prize, HWI may choose an additional winner (as in 4. above) to replace him or her.
6. The screen name(s) of the winner(s) and their known Country of residence may be displayed in the HWI Forum and on the HWI Website.
7. Members of HWI management and staff (*if involved in setting the competition question(s) or if aware of the official answer(s) or if involved in determining the winner(s)*) and members of their household are not eligible to enter (with the exception of some 'for fun' competitions with no material prize). Additional limitations may also be imposed, such as a minimum age, and these (if any) will be stated within the rules of a specific competition.
8. There will be no cash alternative(s). Where any prizes are provided by a third party (e.g. CDs by a record company or its agent) that third party is responsible for providing the prize(s) either to HWI for onward transmission to the winner(s), or for delivering it/them directly to the winner(s) as stated in the specific rules for each competion. Prizes provided by third parties are offered by HWI in good faith based on clear discussions and agreement with the parties concerned but HWI and its staff will not be responsible if such third parties ultimately fail to deliver prizes as previously agreed by them.
9. Winners of physical prizes who wish to receive their prize must provide their full postal address to either the third party providing the prize(s), or optionally, to the HWI competition organiser (as stated in the specific rules for each competition). HWI has no control over how winners' addresses are used by any third parties who may provide such prizes but winners will be able to state their preferences to such third parties when providing their name and address. Only companies believed in good faith by HWI to be respected and respectable, and their agents, will be accepted as providers of prizes. Postal addresses if provided to HWI will not be used by HWI *for any other purpose* than delivery of prize(s) of the competition for which they are provided.
10. By entering an HWI competition, all entrants are deemed to have accepted and to be bound by these terms and conditions. Additional rules for specific competitions shall form part of these general terms and conditions.
11. HWI reserves the right, at its sole discretion, to disqualify any individual or individuals who may tamper with the entry process (including but not limited to the use of computer programs, scripts, or any other device or devices intended to automate any aspect of the entry process) and to cancel, terminate, modify or suspend the competition, or amend these terms and conditions should it be deemed necessary by HWI and/or the HWI forum. Competitors’ entries become the property of HWI, whose decision in all matters relating to it shall be final. Certain prizes may be awarded subject to terms and conditions imposed on them by participating third parties e.g. the prize manufacturers distributors or suppliers.
12. HWI accepts no responsibility for:
(a) lost, late or undelivered notifications, communications or entries;
(b) any technical, computer, online or offline, telephone, cable, electronic, software, hardware, transmission, connection, internet, website, or other access issue, failure, malfunction or difficulty that might hinder the ability of an entrant to submit his or her entry or receive any prize(s);
(c) any event outside of our direct control which may cause the competition to be disrupted corrupted or abandoned.
13. Additional specific rules for each competition will be posted at the time of each competition.
14. Remember, HWI competions are free, and for fun!
